Article 1: General

1.1 These general terms and conditions of sale apply to all offers, agreements, deliveries and services by Sportimage - Aboutimage, unless otherwise agreed upon in writing.

1.2 By placing an order, the client agrees to these terms and conditions.

Article 2: Offers and tenders

2.1 All offers and quotations made by Sportimage are without obligation, unless explicitly stated otherwise.

2.2 The prices mentioned in an offer are exclusive of VAT, unless otherwise indicated.

Article 3: Prices and payment

3.1 All prices are in Euros and are exclusive of VAT, shipping costs and any other levies, unless otherwise stated.

3.2 Payment must be made within [30] days of the invoice date, unless otherwise agreed in writing.

3.3 If the client defaults on payment, Sportimage - Aboutimage is entitled to charge statutory interest and any collection costs.

Article 4: Delivery

4.1 Delivery will be made to the address provided by the client, unless agreed otherwise.

4.2 Delivery times are indicative and cannot be considered deadlines.

4.3 The risk of loss of or damage to the products passes to the customer at the time of delivery.

Article 5: Retention of title

5.1 All goods delivered remain the property of Sportimage - Aboutimage until the client has fulfilled his payment obligations in full.

5.2 The client is not entitled to pledge or otherwise encumber the delivered goods.

Article 6: Complaints and returns

6.1 Complaints about delivered products must be reported in writing within [14] days after delivery.

6.2 Returns will only be accepted if previously agreed in writing and the products are in their original condition. (Personalized items will not be taken back)

Article 7: Liability

7.1 Sportimage - Aboutimage is not liable for indirect damages, including consequential damages, lost profits and business interruption.

7.2 Sportimage - Aboutimage's liability is limited to the amount paid by the client for the products or services in question.

Article 8: Force majeure

8.1 Sportimage - Aboutimage is not liable for delays or failure to fulfill obligations due to force majeure, including but not limited to natural disasters, pandemics, strikes or disruptions in transport.

Article 9: Applicable law and disputes

9.1 All agreements between Sportimage - Aboutimage and the client are exclusively governed by Dutch law.

9.2 Disputes will be submitted to the competent court in the district of Leuven.

Article 10: Privacy

10.1 Sportimage - Aboutimage processes personal data in accordance with applicable privacy legislation. More information can be found in our privacy statement.
